Terms of Service
These Terms of Service apply to purchases and use of the Your House Plans website. By placing an order, the customer agrees to these terms together with the applicable Plan Licence, Refund Policy and Privacy Policy.
1. Our Services
Your House Plans provides pre designed residential house plans and related site specific professional services.
Customers may select between:
Digital Plan Package
A standard digital drawing package for the selected house design.
Site Specific Professionally Certified Plan Package
The selected house design together with site specific architectural adjustments, professional review and certification by appropriately registered architectural professionals.
The exact scope and price of each package are shown on the relevant product page.
2. Digital Plan Packages
Digital Plan Packages are supplied electronically after successful payment.
The drawings represent the house design selected by the customer and are not site specific unless expressly stated.
Site adaptation, professional certification, municipal submission, engineering and specialist services are not included in the Digital Plan Package.
3. Site Specific Professionally Certified Plan Packages
The Site Specific Professionally Certified Plan Package includes adaptation of the selected design based on the property information supplied by the customer.
The service may include:
- site plan preparation
- adjustment of the selected design to the supplied site information
- review of applicable building lines and basic site constraints
- preparation of the required architectural drawing set
- professional review
- professional certification by appropriately registered architectural professionals
- electronic delivery of the completed certified drawing package
The exact scope may vary depending on the property and project requirements.
4. Client Site Information
Customers purchasing a Site Specific Professionally Certified Plan Package must provide the information reasonably required to complete the service.
This may include:
- property address
- erf number
- SG diagram
- title deed
- zoning information
- site dimensions
- estate guidelines
- survey or contour information
- other relevant property documentation
The customer is responsible for ensuring that all information supplied is accurate and complete.
Delays caused by missing or incorrect information may affect the completion timeframe.
5. Design Adjustments
Site related adjustments reasonably required to adapt the selected design may form part of the certified package.
Substantial changes to the original design are not automatically included.
Examples may include:
- major changes to the building footprint
- additional bedrooms or storeys
- significant changes to the roof design
- major structural changes
- substantial changes to the accommodation schedule
- extensive redesign requested by the customer
Where additional design work is required, a separate quotation may be issued before that work proceeds.
6. Municipal Submission
Your House Plans does not submit drawings to the municipality as part of the standard packages unless expressly agreed otherwise in writing.
The customer is responsible for:
- submitting the completed drawings to the relevant municipality
- paying municipal application and scrutiny fees
- providing any additional documentation requested by the municipality
- complying with municipal administrative requirements
Professional certification does not constitute municipal approval.
Approval remains subject to the relevant authority.
7. Additional and Specialist Services
Unless specifically stated otherwise, the following are excluded:
- structural engineering
- civil engineering
- geotechnical investigations
- land surveying
- town planning applications
- rezoning
- consent use applications
- building line relaxation applications
- estate approval fees
- fire engineering
- specialist certificates
- construction supervision
- substantial redesign work
If any of these services become necessary, they may require separate appointments and additional fees.
8. Prices and Payment
All prices displayed on the website are shown in South African Rand unless stated otherwise.
Payment must be completed through the payment methods available at checkout.
Your House Plans may amend prices from time to time. Any change will not affect an order that has already been successfully paid for.
Additional services requested after purchase may be quoted separately.
9. Delivery
Digital Plan Packages are delivered electronically after successful payment.
Site Specific Professionally Certified Plan Packages begin once the required property information has been received.
The completed certified drawing package will be delivered electronically once the required adjustments, review and professional certification are complete.
Completion times may vary depending on the complexity of the property, completeness of information and extent of adjustments required.
10. Customer Responsibility
Before purchasing a plan, the customer should review the:
- house design
- accommodation
- approximate floor area
- package selected
- package inclusions and exclusions
- Plan Licence
The customer is responsible for determining whether the selected house design is suitable for their intended property and requirements.
Where professional site adaptation is required, the Site Specific Professionally Certified Plan Package should be selected.
11. Intellectual Property and Plan Licence
All drawings, house designs, renders, layouts and associated material remain protected by copyright and other applicable intellectual property rights.
Purchasing a plan does not transfer ownership of the design.
Use of the drawings is governed by the Your House Plans Plan Licence.
Unless otherwise agreed in writing, a purchased plan may be used for one dwelling on one property only.
Plans may not be resold, redistributed or commercially reproduced.
12. Refunds and Cancellations
Refunds and cancellations are handled in accordance with the Your House Plans Refund Policy and applicable South African law.
Customers should contact us as soon as possible if they have made an incorrect or duplicate purchase.
Where professional work has already commenced, any cancellation or refund may take into account work already completed and costs already incurred.
13. Accuracy of Information
We aim to ensure that product descriptions, specifications and prices displayed on the website are accurate.
Minor errors may occasionally occur.
Where a material error affects an order, we will contact the customer and take reasonable steps to resolve the matter.
14. Renders and Marketing Images
Architectural renders and other visualisations are provided to communicate the intended appearance and character of the house design.
Finishes, landscaping, furniture, fittings, colours and surrounding context shown in renders may be illustrative and are not necessarily included in the purchased drawing package.
The architectural drawings and product description should be used to determine the actual content of the purchased design.
15. Construction
Purchasing architectural drawings does not replace the responsibility of contractors, engineers or other appointed professionals during construction.
Site dimensions, levels, structural requirements and construction conditions should be verified before building work proceeds.
Construction must comply with applicable approvals, regulations and professional requirements.
16. Limitation of Scope
A pre designed house plan cannot account for every possible site condition before property information has been reviewed.
Your House Plans is not responsible for costs arising from site conditions, restrictions or third party requirements that were not disclosed or reasonably identifiable from the information supplied by the customer.
Nothing in these Terms excludes any responsibility or consumer right that cannot lawfully be excluded.
17. Website Use
Users may browse the website and purchase products for lawful purposes.
Users may not:
- interfere with the operation or security of the website
- attempt unauthorised access
- copy or reproduce website content for commercial use
- misuse product images or architectural drawings
- use the website for fraudulent activity
18. Privacy
Personal information is handled in accordance with the Your House Plans Privacy Policy.
Customers purchasing professional packages may be required to provide property documents necessary to complete the service.
19. Changes to These Terms
These Terms of Service may be updated from time to time.
The latest version published on the website will apply to future purchases.
20. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
