Plan Licence
By purchasing or receiving a house plan from Your House Plans, the purchaser agrees to the following terms of use.
1. Licence to Use
The purchase of a house plan grants the purchaser a limited, non exclusive licence to use the selected design for the construction of one dwelling on one property, unless otherwise agreed in writing.
The purchase does not transfer ownership of the design, drawings or intellectual property.
2. Copyright
All house plans, drawings, renders, layouts, graphics and related design material supplied by Your House Plans remain protected by applicable copyright and intellectual property law.
The purchaser may not copy, reproduce, resell, distribute, publish, share or commercially exploit the drawings except as necessary for the permitted construction project.
3. One Property Use
A purchased plan may be used for one property only.
Use of the same plan for another property, development or additional dwelling requires a separate purchase or written licence from Your House Plans.
4. Digital Plan Package
The Digital Plan Package provides the standard drawing set for the selected house design.
The purchaser may provide the drawings to their appointed architectural professional, engineer, contractor, municipality or other relevant project consultants where this is necessary for the authorised project.
The Digital Plan Package does not include site specific adaptation or professional certification unless stated otherwise.
5. Site Specific Professionally Certified Plan Package
The Site Specific Professionally Certified Plan Package includes adaptation of the selected house design based on property information supplied by the client, together with professional review and certification by appropriately registered architectural professionals.
The certified drawings are prepared specifically for the property identified for that purchase and may not be transferred to another property without further review and written approval.
6. Site Information
The purchaser is responsible for providing complete and accurate site and property information.
This may include the property address, erf number, SG diagram, title deed, zoning information, estate guidelines, surveys, contours and other documents where required.
Additional work resulting from incorrect, incomplete or changed site information may be quoted separately.
7. Design Changes
The purchaser may not alter, reproduce or adapt the design for resale or use on another property.
Where modifications are required for the authorised project, they should be undertaken by appropriately qualified professionals.
Substantial changes requested as part of a Site Specific Professionally Certified Plan Package may require an additional quotation.
8. Municipal Approval
Purchase of a plan does not guarantee municipal approval.
The purchaser remains responsible for submitting the required drawings and documentation to the relevant municipality and for paying municipal application and statutory fees unless otherwise agreed in writing.
Requirements may differ between municipalities, estates and individual properties.
9. Specialist Services
Unless specifically included in the purchased package, the following are excluded:
- structural engineering
- civil engineering
- geotechnical services
- land surveying
- town planning applications
- rezoning or consent use applications
- building line relaxation applications
- estate approval fees
- specialist certificates
- substantial redesign work
Where required, these services may need to be appointed separately.
10. Construction Responsibility
The purchaser and appointed construction professionals are responsible for verifying dimensions, site conditions, construction requirements and applicable regulations before construction begins.
The drawings must not be used in a manner that conflicts with applicable legislation, regulations or professional requirements.
11. Prohibited Use
The purchaser may not:
- resell the drawings
- upload the complete drawings to another website
- distribute the drawings as templates
- sell modified versions of the design
- use the plan for multiple properties without permission
